Affiliate Terms and Conditions

Introduction

These Terms and Conditions govern the relationship between ETEKET, operated by
NOVA PAZAR TRADING, and the affiliates participating in the ETEKET Affiliate Marketing Program.

Submitting an application to join the Program or using the affiliate’s dedicated marketing links constitutes full acceptance of these Terms and Conditions. Please read them carefully before registering or beginning any promotional activity.

ETEKET reserves the right to accept or reject any application. ETEKET may also amend these Terms and Conditions whenever necessary, and any amendment will become effective from the date it is published on the Platform.

Eligibility Requirements

To join the ETEKET Affiliate Marketing Program, an applicant must:

  • Be at least 18 years old.
  • Provide accurate, complete, and up-to-date information during registration.
  • Provide a valid email address and telephone number for communication.
  • Clearly disclose the channels that will be used for promotion.
  • Comply with the laws and regulations applicable in the United Arab Emirates and in every country where promotional activities are conducted.
  • Obtain any advertising permit or licence legally required before publishing promotional content.
  • Not use the Program for any unlawful or unauthorised purpose.

Submitting a registration application does not mean that the applicant is automatically accepted. Every application is subject to review and approval by the ETEKET team.

Affiliate Account

The Affiliate is responsible for maintaining the confidentiality of the account login details and for all activities carried out through the account.

The Affiliate may not:

  • Share the account with another person.
  • Sell, rent, assign, or transfer the account to a third party.
  • Create more than one account without ETEKET’s prior approval.
  • Register an account using false, fictitious, or impersonated information.
  • Use automated programs, bots, or similar tools to create or operate the account.

The Affiliate must notify ETEKET immediately if any unauthorised use of the account is suspected.

Affiliate Links

After an application has been approved, the Affiliate will receive dedicated affiliate links that may be used to promote products available on ETEKET.

The Affiliate must use the approved links and promotional tools supplied by the Platform so that visits, orders, and commissions can be tracked accurately.

ETEKET will not be responsible for a commission not being recorded if the Affiliate:

  • Uses an incorrect or unauthorised link.
  • Deletes or modifies part of the affiliate link in a way that affects tracking.
  • Publishes an expired, inactive, or broken link.
  • Uses methods or applications that block cookies or other tracking technologies.
  • Directs the customer to the Platform in a way that prevents the system from identifying the referral link.

Commission-Eligible Orders

A commission will be calculated only for an order that satisfies all of the following conditions:

  • The customer entered the ETEKET Platform through the Affiliate’s approved marketing link.
  • The customer successfully completed the purchase and payment.
  • The order was confirmed and classified as completed and eligible.
  • The order was not cancelled, rejected, returned, or refunded.
  • There is no suspicion of fraud, manipulation, or misuse of the Program.
  • The order passed ETEKET’s final review.

An order or commission appearing as “Pending” in the Affiliate Dashboard does not mean that it has been finally approved. It remains subject to review until the order has been completed and the required verification period has ended.

Commission Rate

The Affiliate will receive a commission of 5% for each eligible and completed order placed through the Affiliate’s approved marketing link.

The commission is calculated on the net value of eligible products after discounts have been applied. It does not include:

  • Shipping or delivery charges.
  • Taxes, government charges, or customs duties.
  • Payment or processing fees.
  • Gift cards or shopping credits, unless ETEKET announces otherwise.
  • Any additional amounts or services that are not eligible for commission.

No commission will be payable for orders that are cancelled, returned, rejected, unpaid, or refunded in full or in part.

Cancellations and Refunds

If an order is cancelled, returned, or refunded after a commission has been recorded, ETEKET may cancel the commission associated with that order.

If the commission has already been paid, ETEKET may deduct its value from future commissions or request that the Affiliate repay it when necessary.

In the event of a partial refund, the commission may be adjusted according to the final value of the eligible products after the refund.

Commission Payments

Approved commissions will be paid according to the payment cycle, minimum payout threshold, and payment methods displayed in the Affiliate’s account or specified in ETEKET’s approved Program policy.

The Affiliate is responsible for:

  • Providing accurate and complete payment information.
  • Updating the information whenever any change occurs.
  • Ensuring that the payment method is registered in the Affiliate’s name or in the name of the legal entity represented by the Affiliate.
  • Paying any bank charges or transfer fees imposed by the receiving institution.

Payment may be postponed when there are pending orders, incomplete information, or suspected violations of the Program Terms, until the review has been completed.

ETEKET will not be responsible for transfer delays caused by incorrect information, banking restrictions, or circumstances beyond its control.

Taxes and Financial Obligations

The Affiliate is solely responsible for declaring income and paying any taxes, fees, or financial obligations arising from commissions received, in accordance with the laws applicable in the Affiliate’s country.

ETEKET may request any necessary legal or tax documentation before approving the account or paying commissions.

Advertising and Promotional Rules

When promoting ETEKET products, the Affiliate must:

  • Provide accurate, clear, and non-misleading information.
  • Clearly disclose the advertising or promotional nature of the content whenever required.
  • Explain that the Affiliate may receive a commission when a purchase is completed through the Affiliate’s link.
  • Use product images and information accurately.
  • Not make promises or guarantees that have not been approved by ETEKET.
  • Not publish prices, discounts, or offers that are not available on the Platform.
  • Respect intellectual property rights and copyright.
  • Comply with the policies of social media platforms and other channels used.
  • Comply with all laws regulating advertising and digital marketing.

The Affiliate is responsible for obtaining an advertiser permit or any other authorisation required by the competent authorities for the Affiliate’s advertising activities.

Use of the ETEKET Name and Trademark

ETEKET grants the Affiliate a limited, non-exclusive permission to use approved marketing materials solely for the purpose of promoting the Platform while participating in the Program.

The Affiliate may not:

  • Modify the ETEKET logo or visual identity without approval.
  • Create a website or account that suggests it is an official ETEKET account.
  • Use the ETEKET name in a domain name or username in a misleading manner.
  • Claim to be an employee, official representative, or legal partner of the Platform.
  • Register a trademark or trade name that is identical or confusingly similar to the ETEKET trademark.
  • Use the ETEKET trademark in paid advertisements or search keywords without authorisation.

The right to use ETEKET materials and trademarks ends immediately when the Affiliate’s participation in the Program ends.

Prohibited Practices

The use of any unlawful, fraudulent, or misleading method to obtain visits, orders, or commissions is strictly prohibited, including:

  • Creating fake or non-genuine orders.
  • Using stolen information or unauthorised payment methods.
  • Manipulating the tracking system or cookies.
  • Using programs or bots to generate artificial visits or clicks.
  • Sending spam messages or carrying out unsolicited marketing.
  • Impersonating ETEKET, a merchant, or a customer.
  • Offering unauthorised discounts, incentives, or cashback.
  • Publishing links in unlawful or offensive content, or content that promotes hatred or violence.
  • Collecting or using customer information without lawful authorisation.
  • Contacting customers in ETEKET’s name without written approval.
  • Purchasing products through the Affiliate’s own link for the purpose of earning commission, unless expressly permitted by the Platform.
  • Forcing users to open a link or store tracking information without their knowledge.
  • Making false claims about the income or profits expected from the Program.

Data Protection and Privacy

The Affiliate must protect any personal data lawfully obtained during promotional activities and must not sell, share, or use such data for any purpose other than the purpose for which it was collected.

The Affiliate may not collect or store ETEKET customer information or communicate directly with customers in the Platform’s name without written approval.

The Affiliate must comply with ETEKET’s Privacy Policy and all applicable data-protection laws.

Account Suspension and Termination

ETEKET may suspend or terminate an Affiliate account at any time for reasons including:

  • Violating these Terms and Conditions.
  • Providing incorrect or misleading information.
  • Suspected fraud or manipulation.
  • Damaging the reputation of ETEKET, its merchants, or its customers.
  • Using unlawful or unethical marketing methods.
  • Failing to complete required documents or requirements.
  • Misusing affiliate links or the ETEKET trademark.
  • Account inactivity for an extended period, in accordance with the Program policy.

When the account is terminated, the affiliate links will stop working, and the Affiliate must remove all ETEKET materials and trademarks from the Affiliate’s channels.

ETEKET may cancel commissions resulting from violations, fraud, or ineligible orders.

Withdrawal from the Program

The Affiliate may request closure of the account and withdrawal from the Program by contacting the ETEKET team.

Payment of any remaining balance after withdrawal is subject to final review. Pending or ineligible commissions, or commissions associated with cancelled or returned orders, will not be paid.

No Guarantee of Earnings

ETEKET does not guarantee a fixed income or a minimum level of earnings through the Program.

The Affiliate’s earnings depend on several factors, including content quality, audience size, user engagement, and the number of eligible and completed orders.

The Affiliate is responsible for all promotional expenses and decisions relating to promotional methods.

Limitation of Liability

ETEKET will not be liable for indirect losses, lost profits, lost data, or lost business opportunities arising from:

  • Use of the Program or inability to use it.
  • Temporary interruption of the website or tracking system.
  • Errors in links created or modified by the Affiliate.
  • Closure of the Affiliate’s account due to a violation of these Terms.
  • Changes in products, prices, or stock availability.
  • Technical, banking, or legal circumstances beyond the Platform’s control.

Amendments to the Program and Terms

ETEKET may amend the Program, the commission rate, commission calculation rules, payment methods, or these Terms and Conditions whenever necessary.

Amendments will be published on the Platform or communicated to the Affiliate through the available communication channels. Continued use of the Program after an amendment has been published constitutes acceptance of the amendment.

New amendments will not apply retroactively to commissions finally approved before their effective date, unless they relate to fraud, a technical error, or a violation of these Terms.

Governing Law and Jurisdiction

These Terms and Conditions are governed by the laws of the United Arab Emirates and the regulations applicable in the Emirate of Dubai.

The courts of the Emirate of Dubai will have jurisdiction over any dispute arising from the ETEKET Affiliate Marketing Program, unless the parties reach an amicable settlement.
