1. Introduction

Welcome to ETEKET, available through ETEKET.SHOP and owned and operated by NOVA PAZAR TRADING, a legal entity registered in the Emirate of Dubai, United Arab Emirates.

These Terms and Conditions govern your use of the website and the services available through it, including creating accounts, browsing products, making purchases, communicating with merchants, and using any other services or features provided by the platform.

By using the website, creating an account, or submitting an order, you acknowledge that you have read, understood, and agreed to comply with these Terms and Conditions, together with the Privacy Policy, Return and Exchange Policy, Shipping and Delivery Policy, and any other policies published on the website. If you do not agree to these terms, please do not use the website.

2. Definitions

For the purposes of these terms, the following words have the meanings set out below:

  • “ETEKET,” “Platform,” or “we”: The ETEKET platform owned and operated by NOVA PAZAR TRADING.
  • “Website”: ETEKET.SHOP and any digital services connected with it.
  • “Customer” or “User”: Any person who visits the website, creates an account, or purchases a product through it.
  • “Merchant” or “Seller”: The third party that displays and sells products through the platform.
  • “Product”: Any item or product offered for sale on the website.
  • “Order”: A purchase request submitted by the customer through the website.

3. Nature of the Platform

ETEKET is a multi-vendor online marketplace that enables independent merchants to display and sell their products to customers. Depending on the nature of each transaction, the platform may manage orders and payments and coordinate shipping and Customer Service.

Unless clearly stated otherwise on the product page, the products displayed are supplied and sold by independent merchants. Each merchant is responsible for the legality, quality, authenticity, safety, accuracy of descriptions and images, pricing, availability, and compliance of their products with applicable laws and regulations.

ETEKET seeks to verify displayed information and monitor merchant performance. However, product information also depends on information provided by the merchant. Customers must read the product description, features, usage instructions, and warnings before purchasing.

4. Eligibility and Use of the Website

Users must be at least 18 years old or use the website under the supervision and with the consent of a parent, guardian, or legal representative capable of entering into a binding contract.

The user agrees to use the website lawfully and legitimately and not to:

  • Provide false or misleading information.
  • Use another person’s account without permission.
  • Attempt to hack or disrupt the website or introduce viruses or harmful code.
  • Copy or commercially exploit website content without written permission.
  • Use the website for fraud, money laundering, or infringement of third-party rights.
  • Publish content that is offensive or contrary to law or public morals.

ETEKET may suspend, restrict, or terminate an account where it is established or reasonably suspected that these terms have been violated, the website has been misused, or harm has been caused to the platform, merchants, or customers, subject to rights provided by law.

5. Account and User Information

Certain services may require the creation of an account and the provision of accurate, complete, and up-to-date information. The user is responsible for:

  • Keeping login details and passwords confidential.
  • All activities carried out through the account, unless unauthorised use is reported without delay.
  • Updating personal, contact, and delivery information when it changes.
  • Informing ETEKET immediately if account compromise or misuse is suspected.

ETEKET is not responsible for losses resulting from the user’s failure to protect their account, except to the extent required by law.

6. Product Information

We and the merchants make reasonable efforts to ensure that product descriptions, images, colours, sizes, and prices are accurate. However, displayed colours may vary slightly depending on the device screen or lighting, and minor variations may exist in handmade products that do not constitute a defect where they do not affect the nature or quality of the product.

If a material error appears in the price, description, or availability of a product, the platform may contact the customer to correct or cancel the order and refund any amount paid to the original payment method.

7. Prices and Fees

Product prices are displayed in United Arab Emirates dirhams unless otherwise stated. Delivery charges and any applicable taxes or fees are displayed to the customer before the order is confirmed.

When purchasing in another currency, the bank or card provider may apply currency-conversion charges or banking fees, which are borne by the customer.

Prices and offers may be changed at any time before an order is confirmed. Such changes do not affect previously confirmed orders, except where an obvious error is corrected in accordance with these terms.

8. Orders and Confirmation

Submitting an order constitutes an offer by the customer to purchase the selected products. An order is not finally accepted until it has been confirmed, payment has been accepted, and product availability has been verified.

An order may contain products from more than one merchant and may therefore be divided into multiple shipments or require more than one related processing or settlement operation.

An order may be rejected or cancelled where a product is unavailable, payment or customer information cannot be verified, fraud is suspected, an obvious pricing or description error exists, or delivery is not possible. If payment has been collected, it will be refunded in accordance with the refund policy stated below.

9. Payment

The payment methods shown on the checkout page are accepted and may include debit cards, credit cards, and other methods provided by the platform.

Payment information is processed through approved payment-service providers and secure connections. Use of a payment method may also be subject to the terms and conditions of the service provider or issuing bank.

The customer confirms that they are authorised to use the submitted payment method and that the billing information is accurate and complete. Customers are advised to retain a copy of the order and transaction record.

10. Order Cancellation

A customer may request cancellation within one hour from the time the order is confirmed, provided that the order has not been shipped and the merchant has not begun fulfilling or preparing it in a manner that makes cancellation impossible.

Products made or modified to order cannot be cancelled after fulfilment has begun unless the merchant agrees or the product is defective or does not conform to the order.

A cancellation request must be submitted through the customer’s account or the approved communication channels. Acceptance of the cancellation depends on the status of the order when the customer’s request is received.

11. Shipping and Delivery

The delivery period is calculated from the date the order and payment are confirmed and may vary according to product availability, customer location, the nature of the shipment, the merchant, and the delivery company.

Estimated delivery periods:

  • Within the United Arab Emirates: Two to five business days.
  • To GCC countries: Seven to ten business days.

These periods are estimates and do not guarantee a fixed delivery date. Delivery may be affected by public holidays, customs procedures, weather conditions, delivery-company restrictions, or circumstances beyond reasonable control.

The customer is responsible for entering a correct address and phone number and ensuring that the shipment can be received. Additional redelivery charges may apply if delivery fails because of incorrect information or the customer’s failure to respond.

Orders shipped outside the United Arab Emirates may be subject to customs duties or import taxes under the laws of the destination country. Any charges collected by the platform are displayed at checkout. Charges imposed by the destination authorities or shipping company that were not collected in advance are borne by the customer unless otherwise stated.

12. Exchanges and Returns

A customer may request a return due to a change of mind within seven days from the date of receipt, provided that:

  • The product has not been used, worn, washed, or damaged.
  • The product remains in its original condition and is suitable for resale.
  • The original packaging, seals, labels, tags, and accessories are intact.
  • Proof of purchase is provided and the return request is submitted within the specified period.

For a change-of-mind return, the customer bears the return shipping cost and any associated fees unless the platform announces otherwise as part of an offer or special policy.

Change-of-mind returns are not accepted for health or personal products, opened or used products that cannot be resold for health reasons, or products made or modified to order. This exclusion does not prevent the customer from making a claim where the product is defective, damaged, incorrect, or does not conform to the order or description.

If a product arrives defective, damaged, or not as ordered or described, the customer must contact ETEKET within a reasonable period and attach clear photographs of the product, packaging, and order number. In such cases, the merchant bears the cost of return or replacement, and the request will be processed in accordance with the law and the Return and Exchange Policy.

Returned products are inspected before final approval of a return or exchange. Nothing in these terms limits any consumer right granted under the applicable laws of the United Arab Emirates.

13. Refunds

After the returned product has been received and inspected and the refund request has been approved, the refund will be processed within 14 business days.

The refund will be returned to the original payment method used for the order. The customer’s bank or payment-service provider may require additional time for the amount to appear in the customer’s account. This period is not included in ETEKET’s processing period.

For a change-of-mind return, the return shipping cost is not refundable, and the original delivery charge may not be refunded where the service has already been completed, to the extent permitted by law. Where the product is defective, damaged, or non-conforming, the merchant bears the related return charges.

14. Reviews and User-Submitted Content

Customers may publish an honest rating or comment relating to their actual experience. It is prohibited to publish content that:

  • Is false, misleading, or defamatory.
  • Is offensive or racist or infringes privacy or intellectual-property rights.
  • Contains personal information or contact details intended to complete transactions outside the platform.
  • Contains advertisements or unsolicited messages.

ETEKET may review or remove content that violates these terms or the law and is not obliged to publish every review.

15. Intellectual Property

All rights relating to the ETEKET name, logo, design, and platform content, including text, images, graphics, software, and databases, are owned by or licensed to ETEKET unless otherwise stated.

The user is granted a limited, personal, non-exclusive, and revocable licence to use the website for shopping and benefiting from the services. Content may not be copied, reproduced, modified, distributed, or commercially exploited without the prior written consent of the rights holder.

16. Privacy and Data

Personal data is collected, used, and retained in accordance with the Privacy Policy published on the website and the applicable laws of the United Arab Emirates.

Users should review the Privacy Policy to understand the types of data we collect, the purposes for which it is used, their rights relating to it, and the available methods of contacting us.

17. Electronic Communications

The user agrees to receive notifications relating to their account, orders, payments, and shipments through email, text messages, website notifications, or the communication methods they provide.

Marketing communications are sent in accordance with applicable consent and legal requirements. Users may unsubscribe using the method stated in the message, without affecting necessary notifications relating to orders and the account.

18. Website and Service Availability

We seek to keep the website and services available and secure but do not guarantee that they will be uninterrupted or completely free from errors. The website or certain services may be temporarily suspended for maintenance, updates, security purposes, or technical circumstances beyond reasonable control.

New services or features may be added, and existing services may be modified. New features are subject to these terms unless separate terms are published for them.

19. Limitation of Liability

These terms do not exclude or limit any liability or right that cannot legally be excluded or limited.

To the extent permitted by law, ETEKET is not responsible for indirect or consequential losses resulting from misuse of the website, the user’s provision of incorrect information, circumstances beyond reasonable control, or acts of third parties outside the platform’s control.

The platform’s role does not release the merchant from responsibility for the product sold and does not affect the customer’s statutory rights against the merchant or platform according to the nature of the transaction and the applicable law.

20. Force Majeure

Neither ETEKET nor the merchant is responsible for delay or non-performance resulting from circumstances beyond reasonable control, including natural disasters, epidemics, government decisions, interruption of communication or payment networks, logistical disruptions, border closures, or customs delays, provided that reasonable measures are taken to limit the impact and inform the customer where necessary.

21. Amendments to the Terms

ETEKET may amend these terms where necessary to develop the services or comply with legal and regulatory requirements. The updated version will be published on this page together with the date of the latest update.

Amendments take effect from the date of publication and do not apply retroactively to orders confirmed before that date unless the amendment is legally required. Continued use of the website after publication constitutes acceptance of the amendments.

22. Severability

If any provision of these terms is found to be invalid or unenforceable, this does not affect the validity of the remaining provisions. The affected provision will be interpreted or modified only to the minimum extent necessary to make it compliant with the law.

23. Governing Law and Dispute Resolution

These terms and the use of the website are governed by the laws of the United Arab Emirates.

In the event of a complaint or dispute, please contact ETEKET Customer Service first so that an amicable resolution may be attempted. If an amicable resolution cannot be reached, the courts of the Emirate of Dubai will have jurisdiction, without prejudice to any mandatory jurisdiction or consumer right established by law.
